A Variance application has been filed with the Board of Standards and Appeals (BSA) pursuant to §72-21 of the Zoning Resolution of the City of New York to permit a Use Group 6 commercial use in the entire building at the premises. Sixty-two percent (62%) of the premises lies within an R5B zoning district where UG6 uses are not permitted as-of-right; the remaining thirty-eight (38%) percent of the premises lies within a C4-4A zoning district. Since less than half of the parcel is situated within the desired zoning district (i.e. C4-4A), a variance to permit a Use Group 6 uses in the entire building is being sought.</p>

<p style="margin-top: 0in;"><span>The United States Constitution requires that the number of people living in the United States be counted every 10 years. People of all ages, races, ethnic groups, citizens and non-citizens alike, regardless of legal status, are to be counted in the next census in 2010. The United States Department of Commerce’s Census Bureau is responsible for the count.</span></p>

<li><span>The 2010 Census will find out how many people live in New York City, how many elected representatives we will have in Congress, determine who will represent you in the City Council and in the New York State Legislature, determine how much funding we will receive from the federal government for education, healthcare, job training, transportation, senior services, and other critical services important to all New Yorkers.<span>

<li><span>The 2010 Census is a <a href="http://www.nyc.gov/html/census2010/downloads/pdf/2010_questionnaire_info.pdf">form</a> (in <a href="http://www.nyc.gov/cgi-bin/exit.pl?url=http://www.adobe.com/products/acrobat/readstep2.html">PDF</a>) with 10 simple questions that will be mailed to you between February and March of 2010. You will be asked to answer questions about yourself and each person who lives with you. You then must mail back the completed form by April 1, 2010. All <strong><em>personal information</em></strong> you provide in answer to any question on the form is completely <strong><em>private</em></strong> and will not be shared with anyone else. The information you provide is only used for statistical purposes. Under the law, your personal information remains private for 72 years.<span>

<li><span>By law, the U.S. Census Bureau must submit state population counts to President Obama by December 31, 2010 to kick-off the process of deciding what Congressional district you live in and ultimately, who will represent you.</span></li>

<p>Dear New Yorker,</p>
<p>The New York City Council is once again partnering with the Department of Education (DOE), the Administration for Children&#8217;s Services (ACS) and childcare advocates to help <strong>enroll four-year olds in FREE Universal Pre Kindergarten (UPK) programs by Friday, October 30</strong><strong><sup>th</sup></strong>.</p>
<p><span id="more-1097"></span>About 5,000 full-day and half-day UPK seats are still available for children who turned four years old by December 31, 2009, in public schools, childcare centers contracted by ACS and community-based organizations contracted by the DOE.  Research supports UPK as a way to support the social, emotional and academic skills of children as well as prepare children for Kindergarten.</p>
<p>When choosing a UPK program, families can select a vacant seat near where they live, where they work or where they go to school.  Families should also know that selecting a UPK slot in a public school will not guarantee their child a space in the Kindergarten program for the following year.  Moreover, for childcare centers <strong><span style="text-decoration: underline;">ONLY,</span></strong> both three- and four-year olds are eligible to attend UPK programs.</p>
<p>Families should contact individual programs to confirm seat availability and to register.  The following tools are available to help families find childcare centers or public schools with available seats:</p>
<ul>
<li>Families can <strong>call      311</strong> and ask for a UPK program in their neighborhood.</li>
</ul>
<ul>
<li><strong>Call a toll free number      (888) 469-5999</strong> and speak with a parent counselor.</li>
</ul>
<ul>
<li><strong>NYCityMap</strong> lets families search      for UPK programs with available seats close to their home, work or      school.  Families can log on to <a href="http://gis.nyc.gov/doitt/nycitymap/">http://gis.nyc.gov/doitt/nycitymap/</a>,      enter an address first, then click on &#8220;Show Additional Data&#8221; (on      the right hand side at the bottom), and choose &#8220;Universal Pre-K&#8221;      under Education.</li>

			<content:encoded><![CDATA[<p>The <a href="http://www.nyc.gov/html/dof/html/jump/ecb_res.shtml">Penalty Relief Program</a> is a joint program between the City Council and Mayor Bloomberg established through Local Law 47 of 2009, which will run from September 21st until December 21st, 2009.</p>
<p>The Penalty Relief Program will allow businesses and homeowners who have outstanding default judgments against them from the Environmental Control Board (ECB) to pay ONLY the base violation fine amount.  A violation is considered to be in default if the individual or business that received the violation failed to pay the fine or challenge it in a hearing within the required time frame.  Through the program, the City will wave the default judgment, late fees, and all other penalties and interest.</p>
<p><span id="more-1087"></span>ECB violations are issued by such city agencies as Sanitation, Buildings, Consumer Affairs and Transportation.  Businesses and homeowners are commonly issued violations for dirty sidewalks, failure to properly separate recyclable materials, obstruction of sidewalks, vending merchandise without a license of permit and much more.</p>
<p>Individuals and business owners may apply for the program online, by phone or by mail.  The application process takes less than five minutes and all that is needed is the name and address of the business and homeowner.</p>

<p><strong>10/19/09:</strong> The <a href="http://www.cb14brooklyn.com/wp-content/uploads/2009/07/CCF10192009_00000.pdf">NYC Department of Homeless Services</a> has responded to CB14 Chair Alvin Berk&#8217;s <a href="../wp-content/uploads/2009/07/CB-Response-to-DHS-Letter.pdf">letter requesting clarification</a> on what constitutes a homeless shelter.</p>
<p><strong>9/3/09:</strong> CB14 District Manager Doris Ortíz, representatives of the NYC Department of Homeless Services, the Mayor&#8217;s Community Assistance Unit, the 70th Precinct,  Common Ground, and West Midwood Community Association visited 800 East 12th Street with the property owner on Wednesday, August 26th.  The walk-through provided the opportunity to observe that the property is well maintained.  There are four bathrooms on each floor; each room has ceiling fans, hardwood floors and window shades.  The graffiti has been removed from the exterior walls.  There is a live-in superintendent who is maintaining the facility.  Additionally, there are multiple security cameras aimed at multiple points of view to ensure full coverage of each floor, which are checked by the owner&#8217;s security several times a week.  The Police Department continues to conduct vertical patrols twice a week.  Finally, the owner, Michael Rosen, will join the West Midwood Community Association and attend as many meetings as possible.</p>
<p><strong><span id="more-982"></span>8/7/09:</strong> CB14 Chair Alvin Berk has sent a <a href="http://www.cb14brooklyn.com/wp-content/uploads/2009/07/CB-Response-to-DHS-Letter.pdf">letter requesting clarification</a> on what constitutes a homeless shelter in response to the statement that the Board received from the <a href="http://www.cb14brooklyn.com/wp-content/uploads/2009/07/dhs-letter.pdf">NYC Department of Homeless Services</a>.</p>
<p><strong>8/6/09:</strong> Attached are letters from <a href="http://www.cb14brooklyn.com/wp-content/uploads/2009/07/common-ground-letter.pdf">Common Ground</a> (and accompanying <a href="http://www.cb14brooklyn.com/wp-content/uploads/2009/07/common-ground-street-homeless-information.pdf">information on street homelessness</a>) and the <a href="http://www.cb14brooklyn.com/wp-content/uploads/2009/07/dhs-letter.pdf">NYC Department of Homeless Services</a> in response to the community&#8217;s questions.  The Board is currently formulating its response.</p>
<p><strong>7/29/09: </strong>Alain Realty currently does not have any signed contract or signed lease with the other vacant units at the present time.</p>
<p><strong>7/28/09:</strong> Alain Realty has signed a waiver for the Mayor&#8217;s Office to remove graffiti from the side of the building as requested by the neighbors.</p>
<p><strong>7/27/09:</strong> Alain Realty has given the 70th Precinct several keys to access the building for vertical patrols on an as-needed basis</p>
<p><strong><span style="text-decoration: underline;">JULY 17th MEETING SUMMARY</span></strong></p>
<p>Community Board 14 convened an emergency meeting on  Thursday, July 23, 2009 at 7 PM in the District Office to investigate the use of  800 East 12th Street as a facility for temporary homeless housing,  organized by Common Ground, a contractor of the New York City Department of  Homeless Services (DHS).</p>
<p>Among those present included:</p>

<p>Common Ground and DHS gave an overview of the program.  Common Ground, serving as a contractor of DHS, is renting 12 units out of the 30  available units at 800 East 12<sup>th</sup> Street as  temporary housing for the homeless. They have staff that make regular visits to  the location as well as licensed professionals who assess each client and  determine the best methods for meeting their needs.</p>
<p>The members of the community who attended  expressed the following concerns:</p>
<ol>
<li>There appears to be no on-site 24/7 security,  so what measures will be taken to ensure public safety both inside the building  and the surrounding areas?What are the terms of the contract between  Common Ground and DHS, especially regarding notification to CB14 and the  community?</li>
<li>What percentage of the clients come from  Community District 14? How many from what other locations?</li>
<li>Are there any statistics about, e.g., drug use  incidence, available on the clientele living at this facility?</li>
<li>What kind of staff are on-hand during the night  at the facility?</li>
<li>Is smoking permitted in the facility?</li>
<li>Are there any individuals who are registered  sex offenders? Is there a requirement to register when they reside at a  temporary shelter? Does DHS require sex offenders to register when residing at  DHS-funded temporary housing? Does DHS make Common Ground responsible for  this?</li>
<li>Will the owner permit NYPD officers to conduct  regular patrols in the building?</li>
<li>Will the exterior of the building be repainted  to remove graffiti?</li>
<li>What will the other 18 units be used  for?</li>
</ol>
<p><strong>Commitments:</strong></p>
<p>Within the next 10 days, DHS, Alain Realty, and  Common Ground will get back to CB14 with answers to the above  questions.</p>
